Byers & Harvey
Please read this Vacation Rental Agreement ("Agreement") carefully before booking or occupying the property.

1. AGREEMENT ACCEPTANCE
Any payment received by Byers & Harvey (“Company”) for occupancy of a vacation rental property constitutes the Guest’s acceptance of this Agreement and all incorporated policies in full. All policies are strictly enforced.

2. NATURE OF OCCUPANCY
This Agreement grants the Guest a temporary, revocable license to occupy the property for lodging purposes only. No tenancy, leasehold interest, or possessory estate is created, regardless of length of stay. The property is not the Guest’s primary residence, and Tennessee landlord–tenant statutes are expressly disclaimed and do not apply.

3. PRIMARY GUEST REQUIREMENTS
For legal and accounting purposes, the individual placing the reservation must be the same individual whose credit or debit card is used for payment (the Primary Guest). All other occupants are considered the Guest’s invitees. All communications regarding the reservation shall be conducted solely with the Primary Guest.

4. THIRD-PARTY GUEST VERIFICATION
As a condition of booking and occupancy, the Primary Guest must successfully complete third-party identity and fraud-prevention before check-in. Verification may include submission of:
  • A valid, unexpired government-issued photo identification (e.g., driver’s license or passport);
  • A real-time selfie to confirm identity; and
  • A valid credit card in the name of the Primary Guest, which must match the reservation details.
Failure to complete verification, or submission of inaccurate, expired, or fraudulent information, constitutes a material breach of this Agreement and may result in cancellation or immediate termination of occupancy without refund.

Completion of verification is required solely for security, fraud prevention, and property protection purposes and does not create or imply any tenancy, residency, or possessory rights.
5. PAYMENT TERMS
  • 1–29 Nights: Payment is due in full prior to check-in.
  • 30–89 Nights: A monthly payment plan may be permitted. The first month will be prorated based on the check-in date. All subsequent payments are billed at the full monthly rate on the agreed schedule. Occupancy remains temporary.
  • 90+ Nights: Monthly payments apply as above. Guest expressly waives any tenancy rights to the maximum extent permitted by law. A security deposit is required. Occupancy remains a temporary lodging arrangement only.
Failure to pay any amount when due constitutes grounds for immediate termination of occupancy.
6. CANCELLATIONS & REFUNDS
Power / Weather / Acts of Nature
No refunds are issued for acts of nature, including but not limited to weather conditions, road closures, snow, power outages, or similar events.

Taxes & Fees
  • If the stay is 1–29 nights: Certain state and local occupancy taxes and platform fees may be non-refundable.
  • If a reservation is booked or extended for 30+ nights and later shortened for any reason: Guest may be subject to retroactive occupancy and state taxes as required by law.
Guest-Initiated Cancellations
  • If the stay is 1–29 nights: Cancellation terms follow platform-specific policies. Direct bookings are non-refundable unless third-party trip insurance was purchased at the time the reservation was confirmed.
  • If the stay is 30–89 nights: A cancellation fee may apply and will be deducted from prepaid rent. Guest authorizes a secondary charge if necessary to cover residual expenses (if applicable).
  • If the stay is 90+ nights: A cancellation fee may apply for early termination. The outstanding balance may be deducted from the security deposit or prepaid rents to cover out-of-pocket expenses, including but not limited to fees or retroactive taxes.
7. DAMAGE & CHARGE AUTHORIZATION
Guest expressly authorizes Company to charge the Guest’s payment method for uncovered damage, excessive cleaning, service calls, eviction-related costs, and property loss discovered during or after occupancy.
8. EMERGENCIES & MAINTENANCE
For access issues or urgent maintenance affecting habitability, contact the Company immediately at (931) 919-1777.

9. CHECK-IN & CHECK-OUT
  • Check-In: Standard check-in time is 4pm. Early entry requires prior written approval and may incur additional fees. Unauthorized early entry is prohibited.
  • Check-Out: Standard check-out time is 10am.  Late check-out requires prior approval and may incur fees. Unauthorized late departure will result in hourly charges (minimum one hour). Failure to vacate within two (2) hours may result in a charge equal to one full night’s rental rate and does not grant continued occupancy rights.
10. ARRIVAL & CONDITION ISSUES
Guest must report any issues immediately upon arrival. Failure to do so waives any claim for refunds or adjustments.
11. NUMBER OF GUESTS & CONDUCT

Occupancy may not exceed the number listed on the reservation. Unauthorized guests may result in additional charges per person and immediate termination of occupancy without refund.
The property is not intended for parties or gatherings. Excessive noise, illegal activity, or policy violations may result in immediate removal and additional charges.

12. LINENS & TOWELS
Guest is financially responsible for damaged, missing, or excessively soiled linens and towels beyond normal use.

13. SMOKING
Smoking of any kind is strictly prohibited indoors. Evidence of smoke odor will result in excessive cleaning fees. Candles and incense are prohibited except approved outdoor citronella or emergency candles. 

14. PETS
Pets are permitted only in designated pet-friendly units with prior written approval. Dogs only; no cats. Unauthorized pets may result in fees and immediate termination without refund.

15. PLUMBING
Do not dispose of feminine products, wipes, or grease in plumbing. Damage resulting from misuse will be charged to the Guest.

16. RIGHT OF ENTRY
Company may enter the property at reasonable times and with reasonable notice when practicable to verify compliance, investigate disturbances, or perform maintenance.

17. TERMINATION OF OCCUPANCY
Violations of this Agreement may result in immediate termination of occupancy and removal without refund and without creation of a tenancy or eviction proceeding.
18. EXTENDED STAY CONDITIONS
If the Guest’s stay is 30 nights or longer, the following additional conditions apply:
  • Occupancy remains temporary lodging only and not a residence
  • Guest may not use the property address for mail, identification, voter registration, school enrollment, or employment records
  • Company may conduct periodic inspections or housekeeping with reasonable notice
  • Guest may not alter the property or utilities
  • Upon termination, Guest agrees to vacate immediately and authorizes lawful removal of belongings consistent with Tennessee law
19. USE OF PROPERTY & LIABILITY DISCLAIMER
Guests and invitees use the property at their own risk. Company and property owners are not liable for injury, illness, loss, allergic reactions, or damages arising from Guest actions, appliance use, environmental conditions, or utility interruptions.

Guest agrees to release, indemnify, and hold harmless Company and property owners from all claims arising from occupancy by Guest or invitees.
20. GOVERNING LAW
This Agreement is governed by the laws of the State of Tennessee, with venue in Montgomery County, Tennessee. 

21. SMS INTRODUCTION
By accessing or using our services, including receiving SMS communications, you agree to comply with and be bound by these Terms & Conditions. If you do not agree with these terms, please do not engage with our services. The information (Phone Numbers) obtained as part of the SMS consent process will not be shared with third or affiliate companies for marketing purposes.
22. CONSENT FOR SMS COMMUNICATION
By providing your consent to receive SMS communications, you acknowledge and agree to receive text messages from Byers & Harvey at the phone number you provide. Information obtained as part of the SMS consent process will not be shared with third parties or their affiliates for marketing purposes.
23. TYPES OF SMS COMMUNICATIONS
If you have consented to receive text messages, you may receive SMS communications related to updates regarding your upcoming reservation, or other relevant information.
24. STANDARD MESSAGING DISCLOSURES
  • Message and data rates may apply. Standard messaging rates will be charged by your mobile service provider. Many carriers charge a fee for each message sent or received. This can vary depending on the carrier's pricing structure and whether the message is sent domestically or internationally.
  • Message Frequency May Vary
  • You can opt-out of receiving SMS messages at any time by texting "STOP" to the number from which you received the message.
  • For assistance, text "HELP" or visit our Privacy Policy and Terms of Service.
25. OPT-IN METHOD
Guests can Opt-In for SMS messaging from Byers & Harvey through intakes forms on our website, this agreement for SMS will not be shared with third parties or their affiliates for marketing purposes.
26. OPT-OUT METHOD
Guests are able to opt out of SMS messaging from Byers & Harvey by replying STOP at any time to any received SMS message, once opted-out they will receive no further SMS communication. They can Opt back In at any time by replying START.
27. PRIVACY
We respect your privacy and will only use the information you provide to communicate with you via SMS as outlined above. Your personal data will not be shared with third parties or their affiliates unless required by law or as necessary to deliver the requested service.
28. MODIFICATIONS
We reserve the right to update or modify these Terms and Conditions at any time. Any changes will be posted on this page with an updated revision date. By continuing to engage with our services, you agree to be bound by any changes to these terms
